The first tranche of people eligible to reclaim their employment tribunal fees have been contacted, following a Supreme Court judgment that found fees were unlawful.

The first stage of the phased implementation scheme has begun, with around 1,000 people being individually contacted and given the chance to complete a refund application. The full scheme is scheduled to be opened up in the coming weeks.

As well as being refunded their original fee, successful applicants to the scheme will also be paid interest of 0.5%, calculated from the date of the original payment up until the refund date.

The first phase of the refund scheme will last for around four weeks. Further details of the scheme, including how it can be accessed, will be made available when it is rolled out fully.

For those who have paid employment tribunal fees, but have not been invited to take part in the initial stage, the Courts and Tribunals Service is setting up a pre-registration scheme so that they can register an interest in applying when the full scheme is rolled out.
