The role of HR in disciplinary proceedings has been examined by the Court of Appeal.

2016, sees the start of various high profile cases either being heard on appeal or ruled upon. The case of Ramphal v Department for Transport [2015] IRLR 985 EAT is expected to go before the Court of Appeal. When the case was heard in 2015 the Employment Appeals Tribunal (EAT) gave a detailed explanation of the role of HR in such cases.

HR professionals should be aware of the importance of this case and that guidance may be provided by the Court of Appeal on advice given by HR in disciplinary proceedings that could have an improper influence on the outcome of such proceedings.
