As previous announced, the Flexible Working Bill has now received Royal Assent and as such will form part of the Employment Relations (Flexible Working) Act 2023.

The Act will make provision in relation to the right of employees and other workers to request variations to particular terms and conditions of employment, including working hours, times and locations. The areas of inclusion are as below:

Flexible working changes gives the further right to request contract variation

An employee may not make more than two applications under this section to the same employer during any period of 12 months (currently just one)

The act is also amended as so that the employer shall not refuse the application unless the employee has been consulted about the application

Remove the requirement that the employee must explain in the statutory request what effect the change would have on the employer and how that might be dealt with
